Trademark and Patent Filings in Türkiye: Documents

Trademark, patent and design filings in Türkiye with foreign documents: priority documents, powers of attorney, assignments and sworn translations.

Applicants from abroad who file trademarks, patents or designs with the Turkish Patent and Trademark Office (TÜRKPATENT) rely on documents from their home country. The Industrial Property Code (No. 6769) and its implementing regulation say how they are submitted.

Representation and priority

Applicants resident abroad can act before the Office only through an attorney. The Office may ask for the original or a certified copy of the power of attorney; the regulation allows the original or a copy certified by the attorney, lets the Office ask for a notarised copy, and requires the power of attorney to follow the formats published on the Office's website.

A claim to priority requires a priority document. For trademarks and designs, the regulation asks for its original together with a Turkish translation certified by a sworn translator; for patents, a Turkish translation of the register page. The Code also sets the language rule for patent applications. A letter of consent must be notarised.

Transfers and changes

Under the Code, a contract assigning a right is valid only if notarised. Where it is in a foreign language, a Turkish translation certified by a sworn translator is required. The regulation applies the same rule to foreign-language documents for trademark and patent licences, mergers and other structural changes, changes of name or legal form, pledges and certificates of inheritance, and sets a general rule for documents submitted in a foreign language. The Office may ask for any evidence, including notarial certification.

The Code and regulation texts we quote do not mention an apostille or consular certification.

We prepare sworn translations of priority documents, assignments and licences in Ankara through translators sworn before a Turkish notary. TÜRKPATENT decides on the filing.
